Terms of Use

Welcome to Gleamz! These Terms of Use ("Terms") govern your access to and use of the Gleamz website, mobile application, and related services (collectively, the "Service"). By accessing or using Gleamz, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Gleamz

Gleamz is an AI-powered assistant that helps you create listings, suggest pricing, and communicate with buyers to sell your second-hand items. We aim to make selling easier, but Gleamz is a tool—not a marketplace or payment processor.

2. Eligibility

You must be at least 16 years old (or meet the minimum age requirement in your jurisdiction) to use Gleamz. By using the Service, you represent that you meet this requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@gleamz.ai if you suspect unauthorized access.

4. AI-Generated Content

Gleamz uses artificial intelligence to help you create listings. By using the Service, you acknowledge and agree that:

• AI Limitations: AI-generated titles, descriptions, pricing suggestions, and buyer responses may contain errors, inaccuracies, or inappropriate content.
• Your Responsibility: You are solely responsible for reviewing, editing, and approving all content before it is published or sent.
• No Guarantee: We do not guarantee that AI-generated content will result in sales, accurate pricing, or compliance with marketplace policies.
• Human Oversight: All AI-generated buyer communications require your approval before being sent. You maintain final control over all interactions.
• Marketplace-Specific Review: Some marketplaces (e.g., Etsy) require you to attest to item characteristics such as whether the item is handmade, vintage, or a craft supply. When publishing to those marketplaces, you must explicitly review and approve the title, description, category, tags, and materials before submission. AI suggestions do not constitute attestations by Gleamz.
• Marketplace Data Use.Gleamz does not use data received from connected marketplaces' APIs — including listing content, catalog data, pricing, buyer or seller messages, or order data — to train AI or machine-learning models, except where the source marketplace expressly permits it. Each marketplace's API terms govern; the stricter rule controls.

Gleamz can help you draft listings, suggest pricing, and message buyers, but we do not guarantee that:

• Your item will sell.
• You will receive a specific price.
• AI-generated content is error-free or optimal for every platform.

5. Your Content

You retain ownership of photos, videos, voice recordings, descriptions, and other content you submit ("Your Content"). By uploading content, you grant Gleamz a worldwide, royalty-free license to use, reproduce, modify, and display Your Content solely to operate and improve the Service.

AI Processing: By submitting content, you consent to having it processed by our AI systems and third-party AI providers (including OpenAI, Anthropic, and Google) for the purpose of generating listings, pricing suggestions, and buyer communications. See our Privacy Policy for details on how your data is processed and protected.

If you request deletion of Your Content, we will remove it from active use, though some information may remain in backups or aggregated analytics for a limited time.

Marketplace Data. When you connect a marketplace, Gleamz receives listing, order, buyer, message, and inventory data necessary to operate the Service for you (e.g., shipping address, order details, and, where required, buyer email). We use this data only to operate the Service for you (messaging, fulfillment, support). We do notsell, share for marketing, or use to train AI models any data received from a connected marketplace's API — including listing data, buyer or seller PII, order data, and messages — and we retain it only as long as each marketplace permits. Where a marketplace imposes a stricter rule, that rule controls. Etsy buyer email is requested only when required to complete a transaction and is handled in accordance with Etsy's API Terms of Use.

6. Prohibited Uses

You agree not to:

• Sell illegal, stolen, counterfeit, recalled, or hazardous items.
• List firearms, weapons (including vintage), ammunition, knives marketed as weapons, alcohol, tobacco, vapes, drugs or drug paraphernalia, controlled substances, medicine of any kind, regulated animal products, live animals, human remains, or content that promotes hate or violence.
• List lottery or sweepstakes tickets, event tickets, fireworks or explosives, fake certificates, diplomas or credentials, escort or adult services, dating services, foreign-exchange services, astrology or spiritual-remedy services, pirated or IP-infringing media (books, music, movies, software), or user/lead databases.
• List items you do not have the legal right to sell or that you cannot warrant as authentic and lawfully obtained.
• Misrepresent an item's condition, origin, age, materials, maker, or eligibility for a given marketplace, or post it in the wrong category.
• Manipulate marketplace metrics—including reviews, ratings, views, favorites, or follows—or use Gleamz to inflate engagement artificially.
• Solicit, accept, or attempt to redirect buyers to off-platform payment methods, communication channels, or sales channels in violation of a connected marketplace's rules.
• List used cosmetics, testers, decanters, perfumes without an ingredient list, homemade cosmetics without a full ingredient list, unwashed undergarments, or battery-operated toys that are not new, sealed, and compliant with applicable safety regulations.
• List items requiring a license, permit, or registration unless you hold the required authorization for your jurisdiction.
• Make false or unsubstantiated sustainability, circularity, or “eco” claims about an item.
• Harass, spam, or defraud other users or buyers.
• Attempt to reverse-engineer, scrape, disrupt, or misuse the Service, its underlying technology, or any connected marketplace API.
• Use bots, scrapers, or automated tools against any connected marketplace's website or unauthorised endpoints. You authorise Gleamz to act on your behalf only via each marketplace's sanctioned API or other written agreement.
• Use Gleamz to syndicate listing data sourced from one marketplace's API to a competing marketplace where the source marketplace's API terms forbid that reuse.
• Misrepresent your trader or consumer status under EU/EEA law, including the Digital Services Act (Article 30) and the Omnibus Directive. If you sell as a business in the EU, you warrant that you have provided accurate trader information.

We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.

7. Third-Party Platforms & Payments

Gleamz may integrate with third-party marketplaces. Your use of any such marketplace is subject to its own terms. Gleamz is not responsible for:

• Payment processing or disputes.
• Shipping, returns, or fulfillment issues.
• Actions taken by buyers or sellers on third-party platforms.
• Listing removals, account suspensions, or other enforcement by a marketplace.
• Marketplace-specific authentication outcomes, payout withholding, or item seizure.

7.1 Marketplace Eligibility & Routing

Each connected marketplace has its own item-eligibility rules. Gleamz will only publish your item to marketplaces where it qualifies. In particular:

• If your item does not qualify for a given marketplace, Gleamz will not list it there, even if you select that marketplace. The item may still be listed on other connected marketplaces where it does qualify.
• You are solely responsible for the accuracy of attestations about your item (handmade, vintage age, materials, origin). Gleamz's AI may classify items, but final responsibility rests with you.
• Each marketplace requires the listing be posted in the correct category. You are responsible for confirming category, condition, and required attributes before publish; AI suggestions do not relieve you of this responsibility.
• You must accurately disclose item condition (new / used / second-hand / refurbished). When an item sells on one marketplace, you must promptly mark it sold or unlisted on others; Gleamz's automatic inventory sync assists but does not replace your responsibility.
• Minimum age. Each connected marketplace sets its own minimum-age requirement. You warrant that you meet the minimum age of every marketplace you publish to through Gleamz.

7.2 Connecting a Marketplace

When you connect a third-party marketplace through Gleamz, you also agree to (a) that marketplace's own terms of use, which are linked at the time of connection, and (b) any additional Gleamz representations specific to that marketplace, which are presented to you in the connection flow. By completing connection you accept those representations. Where a representation is materially updated, we will require your acceptance again before continuing to use that marketplace through Gleamz.

7.3 Marketplace API Access & Audits

Marketplaces may revoke or limit Gleamz's API access at any time. If that happens, your listings on that marketplace may stop syncing, expire, or be removed. Gleamz will notify you and route your listings to other connected marketplaces where possible. You are not charged a Gleamz fee for functionality that a marketplace already provides for free; marketplace listing and transaction fees are charged by each marketplace directly. Marketplaces may also audit Gleamz; in such cases Gleamz may be required to disclose your application, listing, or operational data to the marketplace as the audit requires.

7.4 Cross-Marketplace Enforcement

Marketplaces may withhold payouts, destroy or surrender items they deem counterfeit, suspend or terminate accounts, freeze pending transactions, or take other enforcement action without notice. Gleamz cannot reverse marketplace enforcement and is not liable for resulting losses.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

IN NO EVENT WILL GLEAMZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. Our total liability for any claim is limited to the greater of (a) USD 50 or (b) the amounts you paid us in the three months before the claim.

9. Indemnification

You agree to indemnify and hold harmless Gleamz and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.

10. Account Termination

You may delete your account at any time through your Settings page. Upon deletion:

• All your items, listings, and conversations will be permanently deleted.
• Connected marketplace accounts will be disconnected.
• All uploaded media (photos, videos, audio) will be removed from our servers.
• This action is irreversible.

We may suspend or terminate your account if you violate these Terms. In such cases, you may lose access to your data.

11. Changes to the Service & Terms

Gleamz is in early access. Features may change, break, or be removed at any time. We may also update these Terms; if we make material changes, we'll notify you via email or the Service. Continued use after changes constitutes acceptance.

12. Governing Law & Disputes

These Terms are governed by the laws of Israel. Any disputes will be resolved exclusively in the courts of Tel Aviv, Israel, unless otherwise required by law.
